WOODY PARK – GENERAL CONDITIONS OF SALE AND SERVICES

 

Scope

These conditions of sale apply on the one hand by EURL WOODY PARK whose registered office is 198, avenue du maréchal de Lattre de Tassigny 76400 Fécamp, registered in the trade and companies register of Le Havre under the number Siret: 448 848 051 00018 hereinafter referred to as WOODY PARK and on the other hand, by any natural or legal person wishing to make a purchase at reception, by telephone, or via the website of WOODY PARK hereinafter referred to as “the buyer “.

These conditions of sale aim to define the contractual relationship between WOODY PARK and the buyer. The acquisition of a good or a service implies unreserved acceptance by the purchaser of these conditions of sale.

These conditions of sale will prevail over all other general or specific conditions not expressly approved by WOODY PARK.

Article 1 – Orders

An order will be effective after checking availability at the periods chosen by the participant

The service resulting from an order may in no case benefit, even partially, third parties, whether natural or legal persons. The buyer, wishing to order a product or a service must specify:

Order by phone

WOODY PARK, after having communicated the information in Article 2 relating to the cancellation, invites the buyer to consult these T & Cs.

An estimate will be made and must be validated by the buyer for the order to be valid. The buyer will thus proceed to payment in accordance with the terms set out in Article 5. .

Online order

In accordance with the provisions of Article 1369-5 of the Civil Code, the consumer has the opportunity to check the details of his order and its total price, and if necessary to correct errors before confirming it, thereby expressing his acceptance. To finalize the order, the consumer must read the T & Cs, accept them by checking a box provided for this purpose, and proceed to payment according to the terms set out in Article 5.

Confirmation of the order implies acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions. Article 2 – Cancellation

The quotation proposed, accepted and signed “Good for agreement” cannot be modified less than a week in advance for catering services, and less than 48 hours in advance for other services

 

2.2 Cancellation in the event of bad weather

In the event of cancellation for bad weather or any other cause not attributable to WOODY PARK, an alternative date of service will be proposed.

If this is not possible, WOODY PARK will issue a credit.

 

Article 3 – Late arrival

The buyer must appear on the day and at the time mentioned on the order. In the event of a late arrival, the buyer cannot hold WOODY PARK responsible if all of the services cannot be performed. If the buyer does not show up on the day mentioned on the reservation without having notified WOODY PARK, the sums paid will remain with WOODY PARK. Therefore, no refund is due to the buyer.

 

Article 4 – Group service

For group services, WOODY PARK reserves the right to cancel or modify any group activity if the minimum number of participants is not reached, without compensation. A replacement activity could then possibly be proposed.

Finally, on site, WOODY PARK reserves the right to modify or replace planned activities if circumstances make their practice impossible and / or dangerous. No compensation is paid in the event of a modification of the activity by WOODY PARK.

 

Article 5 – Prices and terms of payment

The prices offered are prices including all taxes in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

WOODY PARK reserves the right to modify its prices at any time, it being understood, however, that the price offered on the day of the order will be the only one applicable to the buyer.

All specific orders from the purchaser will be the subject of a quote previously accepted by the purchaser. An invoice will be established by WOODY PARK and given to the purchaser each time services or products are provided.

The price is payable when ordering in its entirety for over-the-counter and internet purchases. The customer’s bank account will be debited for the amount of the order, upon final validation of the transaction.

For orders by phone, a bank imprint of 30% of the total price will be requested. No direct debit will be made from the customer’s account, who will therefore have to pay for their entire service on the same day. The bank imprint is destroyed upon payment of the service. However, in the event of cancellation, Article 2 applies to this bank imprint

School and Leisure Center: the order is effective upon receipt of either a 30% deposit check, or a copy of the Administrative Voucher or the Town Hall Order Form. The original must be brought on the day of the service.

Article 6 – Insurance

6.1 Customer insurance

The participant is responsible for all damages resulting from his doing.

6.2 Professional liability insurance

WOODY PARK has taken out insurance with CGBA Assurances 149, avenue du Maine 75014 Paris covering any bodily injury, material and immaterial damage that could be caused to participants as a result of deficiencies or failures of its services..

 

Article 7 – State of health and behavior of the participant

The particular and physical nature of outdoor activities requires certain precautions. Each participant agrees to inform WOODY PARK of health problems that could make the practice of this activity dangerous for himself or for others, and in particular the consumption of drugs that could generate an alteration in perception. Likewise, WOODY PARK reserves the right to refuse access or stop the activity of a participant demonstrating suspicious behavior such as:
– Aggression; intemperance; physical or verbal abuse;
– Inconsistent or inappropriate speech;
– Suspicion of intoxication or drug use.

 

Article 8 – Compliance with park regulations

Each participant agrees to comply with the instructions given by WOODY PARK staff as well as the general safety and caution rules and will take care not to endanger the safety of other participants and staff. Any loss or damage to the equipment entrusted by us must be reimbursed by the participant at the replacement rate for the current year.

 

Article 9 – Special conditions related to the adventure trail activity

Access to the courses

Access to the ground is authorized to all under the full responsibility of parents or accompanying adults, with one adult for up to 12 children. The OUISTITI course is reserved for children from 3 years old and up to 1.20 m. The PIVERT and ECUREUIL routes are authorized from 1.10 m. Access to the INDIANA course is authorized from 1.30 m. The VERTIGO and RAFIKI courses are accessible to people over 1.40 m. Young people under 16 must be accompanied by an adult at the rate of one adult for 3 children maximum except for the OUISTITI course. Activities should be performed by one person at a time. The youngest participants must be held and assured by an adult during their progress on the workshops.

Before any activity, each participant must follow the instructions and changes on the demonstration course.

 

Dress code recommended

WOODY PARK strongly advises participants to wear:
– sports shoes, closed;
-closed clothing;
– hair tied.

WOODY PARK declines all responsibility in the event of stains, clothing addicts, injuries on the natural areas of the course (roots; excavation in the ground, flint …) or due to non-compliance with the instructions by the participant.

 

Prohibitions

For safety reasons and out of respect for the forest, it is forbidden:
– smoke inside the park outside the areas provided for this purpose;
– throw rubbish in the park;
– to move outside the footpaths;
– damage plants and plantations;
– to use protective equipment other than those provided by the company WOODY PARK.

 

Article 10 – Special conditions relating to the paintball activity

Age restrictions for those under 18

For children over 16 years old, the participant must issue a signed parental authorization with a copy of a parent’s identity document or accompanied by the parent on site. However, the activity is prohibited for children under 16.

 

Rules applicable on the paintball field

It’s forbidden :
– Consume alcohol and / or smoke on the paintball field;
– No pyrotechnic element is allowed on the paintball field such as rockets or firecrackers;
– Modify, disassemble, add parts to guns;

– To cause any physical contact between the players;

Responsabilities

WOODY PARK is responsible for the proper performance of the Services ordered under the conditions set out in these GTC.

WOODY PARK’s obligations are automatically suspended without its liability being incurred, in the event of non-performance linked to an event of force majeure or fortuitous events, such as, and without this list being exhaustive: bad weather, flood, fire , epidemic, attack, impossibility of access, decisions by authorities, strike. WOODY PARK will inform the consumer of the occurrence of such an event by any means. In this case, the WOODY PARK may offer the consumer another date of consumption of the Services ordered and impacted by the case of force majeure.

 

 

Article 15 – Liability of the service provider

The service provider guarantees, in accordance with legal provisions, to the customer against any lack of conformity of the services and any hidden defect, resulting from a design or performance fault of the services provided and rendering them unfit for the use for which they are intended, to the exclusion of any negligence or fault on the part of the customer, for a period of 24 months from their supply to the customer.

In order to assert his rights, the customer must, on pain of forfeiture of any related action, inform the service provider, in writing, of the existence of the defects within a maximum period of two months from their discovery.

The service provider will rectify or have rectified, at its exclusive expense, the services deemed to be defective.

The service provider’s guarantee is limited to the amount excluding tax paid by the customer for the provision of the services.

On the other hand, WOODY PARK cannot be held liable in the event of:
– Theft, loss or damage of any kind whatsoever, despite the deposit of the participant’s effects in a locker;
– Technical incidents beyond the control of WOODY PARK;
– Measures taken by the WOODY PARK Management for safety reasons.

 

Article 16 – Customer acceptance

These general conditions of sale are expressly approved and accepted by the customer, who declares and acknowledges having perfect knowledge of them, and thereby waives the right to rely on any contradictory document.

 

Article 17 – Complaints – Disputes

Any complaint relating to a service must be submitted to WOODY PARK and notified by registered letter with acknowledgment of receipt within 48 hours of the end of the service.

All disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, their consequences and their consequences will be submitted to the competent courts under the conditions of French common law.
